JUDGEMENT

(1.) Heard Sri Rashtrapati Khare for the petitioners.
(2.) The writ petition has been filed for quashing the orders of Consolidation Officer, Assistant Settlement Officer (Consolidation) and Deputy Director of Consolidation, passed in chak allotment proceedings.
(3.) The Assistant Settlement Officer (Consolidation) proposed two chaks to the petitioner. The petitioner filed an application claiming that plot no. 5-A be allotted in his chak. The Consolidation Officer rejected the objection of the petitioner. The petitioner filed an appeal registered as Appeal No. 282 from the aforesaid order. Before the appellate authority, the petitioner moved an application that his chak on plot no. 36 be abolished and a single chak be allotted to the petitioner on plot no. 53. In case single chak is allotted to him, the petitioner will remove his boring in plot no. 36, without claiming any compensation. The appeal of the petitioner was heard by Assistant Settlement Officer (Consolidation), who by his order dated 15.5.1982 partly allowed the appeal of the petitioner and accordingly relying upon the admission of the petitioner, the valuation of boring has been deleted. The petitioner filed a revision registered as Revision No. 152 from the aforesaid order which has been dismissed by Deputy Director of Consolidation by the order dated 19.7.1982. Counsel for the petitioner submitted that the petitioner has been deprived of his boring on plot n o. 36 without giving it's valuation to him, although his demand for single chak on plot no. 53 has not been satisfied. The petitioner was a small tenure holder and single chak ought to have been allotted to him.;
