Three persons, who claim to be life members of the General Body of Adarsh Uchchattar Madhyamik Vidyalaya Raunija, District Gautam Budh Nagar (hereinafter referred to as the 'Institution'), have filed this petition for quashing the order dated 27th January, 2010 passed by the District Inspector of Schools, Gautam Budh Nagar by which the signatures of Khachera Singh have been attested as Manager of the respondent Committee of Management of the Institution on the basis of the election held on 22nd January, 2010. The petitioners have also sought the quashing of the decision taken by the Regional Level Committee on 6th July, 2010 by which the aforesaid election of the Committee of Management of the Institution held on 22nd January, 2010 in which Khachera Singh was elected as the Manager has been recognised and the representation filed by Veer Pal Singh on 27th March, 2010 has been rejected.
(2.) It transpires from the records of the writ petition that the Institution is a recognised Institution governed by the provisions of the U.P. Intermediate Education Act, 1921. The dispute in the present petition relates to the election held on 22nd January, 2010 for constituting the Committee of Management of the Institution. The District Inspector of Schools attested the signatures of Khachera Singh as Manager of the Committee of Management of the Institution on 27th January, 2010. This order of the District Inspector of Schools was assailed by the petitioners in Writ Petition No.13387 of 2010 which was disposed of on 16th March, 2010 with liberty to the petitioners to approach the Regional Level Committee and a direction was also issued to the Regional Level Committee to decide the matter after hearing the parties concerned expeditiously, preferably within a period of three months.
(3.) It is pursuant to the aforesaid directions that the petitioners filed a representation on 27th March, 2010. The Regional Level Committee in its meeting held on 6th July, 2010 rejected the representation filed by the petitioners and approved the election held on 22nd January, 2010 in which Khachera Singh was elected as the Manager of the Committee of Management of the Institution. This decision was taken by the Regional Level Committee after taking into consideration the representation filed by the petitioners and the other relevant documents including the comments submitted by the Election Officer, the District Inspector of Schools and the Manager. The Regional Level Committee noted that the District Inspector of Schools had, pursuant to the communication dated 26th November, 2009 sent by the Manager, appointed Ashok Shastri, Assistant Teacher as the Election Officer by the communication dated 18th February, 2009 and that the Election Officer had submitted comments that the election programme was published in the newspaper 'Rashtriya Sahara' and all the members of the General Body were intimated of the election programme by UPC and that in the election held on 22nd January, 2010 Dharamraj Singh was elected as the President and Khachera Singh was elected as the Manager. The Regional Level Committee did not accept the objections raised by the petitioners that the members had not been informed; the election programme was not displayed on the notice board; nominations were not filed in the Institution; the proceedings for withdrawal of nomination were not held in the Institution; the election was not held in the campus of the Institution on 22nd January, 2010 and that the newspaper 'Rashtriya Sahara' does not have a wide circulation in the villages.;
