JUDGEMENT

(1.) Heard learned counsel for the petitioner, learned counsel for the respondent-Development Authority and learned Standing Counsel for the State-respondents.
(2.) Auction for sale of various plots within the territorial limits of Meerut Development Authority including Plot No. BC-20 had taken place on 19th March, 2010. Petitioner offered highest bid in respect of the said plot. His offer was to the tune of Rs. 12,100/- per square meter, as against the reserved price of Rs. 10,800/- per square meter. Yet the bid offered by the petitioner has not been accepted and under letter dated 1st April, 2010, petitioner was informed of the said decision of the Vice-Chairman of the Meerut Development Authority, Meerut dated 28th March, 2010. The money deposited by the petitioner towards security to the tune of Rs. 2,73,000/- was returned by way of bank draft. It is against this order that the present writ petition has been filed.
"A copy of the counter affidavit filed has been produced before us today, which is taken on record. In the counter affidavit, it has been stated that under the Government Order dated 20th June, 2011, it has been provided that single bids, need not be accepted, except in exceptional circumstances, and there should be at least two bids in respect of the auction of plots by the Development Authority. With reference to the said Government Order, the Committee constituted by the Meerut Development Authority as per its decision recorded on the note-sheet has disapproved the auction held for Plot Nos. BC-35, 34, 23, 16 and 20, because only one tender was received in respect of the aforesaid plots, meaning thereby that there was only one bid for the plots in question.
According to the Meerut Development Authority, the said decision is in conformity with the Government Order and in terms of the auction notice. On principle single bids have not been accepted. This principal has been applied uniformally. There has been no discrimination."
(3.) Having examined the records of the present writ petition, this Court finds no illegality or infirmity in the decision taken by the Meerut Development Authority. The decision so taken is in-conformity with the Government Order on the subject. There has been no discrimination inasmuch as per the policy, single bid in all cases have not been accepted.;
