JUDGEMENT

(1.) Petitioner had earlier approached before this Court by means of Writ Petition No.64534 of 2012 claiming her admission on the basis of counseling for the B.Ed. course in Rani Bhagyawati Devi Mahila Mahavidyalaya, Bijnor. The college is affiliated to M.J.P. Rohilkhand University, Bareilly. The petition was decided under the order dated 17.12.2012 permitting the petitioner to raise his grievance before the Registrar of the University of Ram Manohar Lohia University (which had conducted the entrance test). The Mahavidyalaya has recognition from the N.C.T.E. for an intake of 100 students only for the B.Ed. course.
(2.) The Registrar of Ram Manohar Lohia Universit has rejected the representation made by the petitioner under the order impugned. It has been recorded that the petitioner after counseling was allotted to Rani Bhagyawati Devi Mahila Mahavidyalaya. However, despite the allotment of the said institution she did not obtain the confirmation slip within the prescribed period of three days, from the counseling centre.
(3.) Since the petitioner did not obtain the confirmation slip from the counseling centre the seat offered to the petitioner continued to be shown as vacant at the counseling centre. Therefore, the candidates lower in merit than the petitioner was allotted the said Mahavidyalaya after counseling. The fault lies with the petitioner of not obtaining the confirmation. Resulting in a situation that all 100 sheets of Mahavidyalaya have been filled after counseling rendering the petitioner as the 101 students. It has, further, been held that the petitioner made an application for confirmation of her admission in the Mahavidyalaya only on 23rd August, 2012 by which that date no sheet was vacant in the Mahavidyalaya concerned.;
