- (1.) Committee of Management, Bhagirathi Arya Kanya Inter College, Lalkurti, Meerut though its Manager Dr. Pramod Sharma has approached this Court assailing the validity of the orders passed by the authorities concerned in reference to the filling up of vacancy for the post of Lecturer in English which has fallen vacant on 30th June, 2012.
(2.) It appears that post of Lecturer in English fell vacant on 30th June, 2012 and the said post in question falls within 50% promotion quota. It further appears that Managing Committee of the Institution in respect of the said post proceeded to pass a resolution opposing the candidature of Km. Sahana Faridi and holding that she was not at all entitled to be promoted. It appears that on the other hand Km. Sahana Faridi approached District Inspector of Schools - II and claimed that she is entitled to be promoted as the said post in question was reserved for OBC candidate. District Inspector of Schools - II on 25th April, 2013 has proceeded to pass an order mentioning therein that with regard to resolution in question Km. Sahana Faridi has approached the authority concerned questioning the validity of the same and further proceeded to mention that the post in question falls within 50% promotional quota reserved for OBC category candidate.

It appears that all the three parties to the litigation i.e. Managing Committee of the Institution, Educational Authorities as well as respondent no. 4 are reeling under misconception that the post in question was reserved for OBC category candidate and further that the Managing Committee of the Institution is of the opinion that Km. Sahana Faridi was unsuitable for the post in question.;
