N.K.Mehrotra, J. - (1.) Petitioner Bachchan Lal Verma is the Principal of the Kisan Inter College Pipra Ismail Gonda. He filed first writ petition No. 3110 (S/S) of 2003 challenging the order dated 30-6-2003 superannuating the petitioner from the post of the Principal and for a writ of mandamus commanding the opposite parties to allow the petitioner to continue to work as Principal of Kisan Inter College Pipra Ismail Gonda till the attainnment of the age of superannuation.
(2.) In Writ Petition No. 3700 (S/S) of 2003 the petitioner challenged the order of suspension-dated 25-6-2003 as contained in Annexure No. 1 of that writ petition and for a writ of mandamus commanding the opposite parties to allow the petitioner to work as the Principal Kisan Inter College, Gonda.

In the earlier writ petition the case of the petitioner is that his date of birth is 16 AV/DV/A 1666/2003/MPK/DPV/3957/2004 3-1945 and in the Service Book the date of birth has been shown as 16-3-1943, which is incorrect. He requested the opposite party to make correction of his date of birth after verifying it from the High School Certificate issued by the Madhyamik Shiksha Parishad, U. P., Allahabad. According to the petitioner the date of birth as recorded in the High School Examination or where a person has not passed any such examination the date of birth as recorded in the Service Book shall be deemed to be correct date of birth. Since in the High School Certificate the date of birth is 16-3-1945, this date will be the correct date of birth and he will retire on 30-6- 2005 on attaining the age of 60 years in the end of the academic session. In support of his contention the petitioner has also filed a photo copy of the certificate of the High School Examination, 1958. The committee of management opposite party No. 4 filed counter-affidavit mentioning therein that a copy of the High School Certificate is the forged one and in the entire service record the date of birth is noted as 16-3-1943. In support of the contention the opposite party filed certain documents C.A. 1 to C.A. 4 to show that the date of birth as 16-3-1943 is admitted date of birth entered in the service record.;
