JUDGEMENT

(1.) VINEET Saran, J. By means of this writ petition the petitioners have prayed for quashing the order dated 9-3-2000 passed by Respondent No. 1, District Basic Shiksha Adhikari, Bulandshahr and the consequential order dated 10- 3-2000 passed by the Respondent No. 3, Committee of Management Ram Chandra Bal Niketan Junior High School Sahkari Nagar, Bulandshahr. A further prayer has been made for a direction to the respondents to pay the salary to the petitioners from December, 1998.

IT is the case of the petitioners that they were appointed on 1- 3-1996 as Assistant teachers in the college of Respondent No. 3 With effect from 1-12-1998 the institution was brought under the grant-in- aid scheme of the Government and 7 posts of Assistant teachers, including Head Master, had been sanctioned under the grant-in-aid scheme. Payment of salary to the petitioners was not made under the grant-in-aid scheme. The impugned order dated 9-3- 2000 has been passed on the basis of the order of the Assistant Director of Education (Basic), Pratham Mandal, Meerut whereby approval was granted for payment of salary under the grant-in-aid scheme to the teachers and employees of the institution who were named in the aforesaid order. The said order dated 15-11-1999 has not been challenged in this writ petition. Only the consequential order dated 9-3-2000 passed by the District Basic Shiksha Adhikari has been challenged.
Having heard learned Counsel for the parties as well as on perusal of record in my view the petitioners are not entitled to the reliefs claimed for. Since the order dated 9-3-2000 has been passed in pursuance of the order dated 15-11-1999 passed by the Assistant Director of Education (Basic) where by payment for only seven teachers had been approved in which the names of the petitioners were not there, the impugned order dated 9-3-2000, which is only a consequential order does not suffer from any irregularity or illegality. The petitioners have not been able to substantiate their right for payment of salary under the grant- in-aid scheme. The Committee of Management had appointed the petitioners as Assistant teachers in the year 1996, much prior to the date on which the institution came under the grant-in-aid scheme. If at all, it would be the obligation of the Committee of Management to pay them their salary depending on the terms and conditions of their appointment Since the salary of only a particular number of teachers had been approved to be paid by the Government under the grant-in-aid scheme, in which the names of the petitioners did not find place, the petitioners are not entitled for a direction for payment of salary to be made by the Government.
In view of the foregoing reasons this writ petition is dismissed being devoid of merits. However, there shall be no order as to costs. Petition dismissed. .;
