(2.) THE applicant Ram Tilak is involved in case Crime No. 236 of 2002 under Sections 392, 411 of IPC P. S. Mahrajganj, District Faizabad. The first bail was rejected on 18-9-02 as not pressed. The main ground taken in this application is than more than six or eight months have elapsed to the first date of recording of the evidence after framing of the charge and so the applicant is entitled to bail under Section 437 (6) of Cr. P. C. Learned Counsel says that the charges were framed in january, 2002 and the trial is still pending and the applicant is in jail for the last 14 or 15 months. State has opposed on the basis of the criminal history. In view of the provision contained under Section 437 (6) of Cr. P. C. , the applicant appears to be entitled to bail.
(3.) LET the applicant be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the C. J. M. concerned. Application allowed. .;
