JUDGEMENT

(1.) THE petitioner was a part time Lecturer in the Government Inter College, Nautanwa, Gorakhpur. The State Government by a policy abolished the system of appointment of part time Lecturer in the Intermediate Colleges. The petitioner approached this Court by filing a writ petition seeking a direction that he is fully qualified and he is entitled to be appointed on regular full time job in the institution. This Court by order dated 8 -4 -1991 finally disposed of the petition directing the Regional Inspector of Girls Schools to consider and decide the petitioner's representation in the light of the observation made by the Hon'ble High Court. After the order of the High Court, the petitioner submitted a representation before the R.I.G.S. who by an order dated 29 -4 -1991 ordered that the State Government by G.O. abolished system of appointment of part time Lecturer in the Intermediate Colleges. The Government Order was mentioned in the order and it was stated that the case of the petitioner was not required to be examined on merits. The representation was rejected.

THE petitioner has again approached before court and filed a writ petition claiming the relief that he being experienced in teaching, have already worked as a part time Lecturer in Intermediate College, is entitled to be recruited and appointed as Lecturer. A.G.O. dated 15th July, 1989 has also been annexed as Annexure 2 to the supplementary affidavit. This G.O. lays conditions for consideration of the case of such part time Lecturer who were working in the Government Intermediate Colleges and removed on the abolition of the system of part time Lecturer. The G.O. provides that a Lecturer who has worked as a part time Lecturer if applies for appointment on regular basis or even for temporary ad hoc basis, they shall be called for interview and shall be given preference in the matter of appointment on the basis of their teaching experience. It has been specifically stated in the writ petition that they are vacant posts available in the Institution and petitioner is fully qualified to be appointed on the said post on ad hoc basis and also on regular basis But grievance is that since the petitioner's case was not considered on merits by the R.I.G.S. the petitioner has suffered irreparably. I have perused the order of the R.I.G.S.
(3.) HEARD the learned counsel for the petitioner and learned standing counsel. I am of the opinion that the petition can be finally disposed of without further waiting for counter affidavit. Perusal of the order of the R.I.G.S. shows that without entering into the merits, the representation was rejected on the ground that system of part time Lecturer in the intermediate Colleges have been abolished As such, representation was rejected The relevant G.O. Annexure 2 with the supplementary affidavit clearly shows that the part time Lecturer who had worked in the Government Intermediate Colleges are to be accommodated and called for the interview on that basis of their experience, provided they are suitable and fit possesses necessary qualifications. The R.I.G.S. appears to have completely ignored the relevant G.O. and rejected the representation.;
