JUDGEMENT

Satish Chandra, C.J. - (1.) It appears that the petitioner passed his M.B.B.S. Examination from Moti Lal Nehru Medical College, Allahabad in December, 1979. He completed his internship in 1980 and then he did his House Job in general medicine in 1981. In December, 1981, the petitioner applied for registration for M.D. Course in general medicine. In the application he gave Pathology his next Job. The authorities did not accept the petitioners application for admission to the M.D. Course in general medicine but they permitted him to join M.D. Course in pathology. The petitioner accepted the Job and had worked there. He came to this Court with the grievance that he was entitled to be registered in M.D. Course in general medicine under Dr. P.C. Saxena, Lecturer in the Moti Lal Nehru Medical College, Allahabad. The petitioners grievance is that the respondents wrongly rejected the petitioners application for registration in M.D. Course in general, medicine on the ground that Dr. P.C. Saxena was not qualified to teach M.D. in general medicine because he was a lecturer in Cardiology and further because he had not completed seven years' teaching experience. The petitioner challenged both these grounds upon which Dr. P.C. Saxena has been held to be disqualified.
(2.) We do not propose to go into the rival submissions. The petitioner has been admitted in Pathology, hence, he was not entitled to be considered for registration to M.D. Course in any other subject like general medicine. There is no averment that the petitioner has in fact given up the studies in Pathology. Under the circumstances, no useful purpose would be served by entering into the controversy that Dr. P.C. Saxena was qualified for registering students in general medicine. The petitioner further challenges the registration of respondent no. 5, Dr. Anand Swarup, in M.D. Course in general medicine. For the reasons mentioned above, it is unnecessary to go into this point. The writ petition fails and is dismissed. We make no order as to costs. Petition dismissed.;
