JUDGEMENT
GIRDHARI LAL, J. -
(1.) HEARD the learned Counsel on the point of admission.
(2.) IT has been argued by the learned Counsel for the appellant that the learned trial Court and lower appellate Court have wrongly dismissed the claim. It has been argued that their possession is long standing possession and on the basis of long standing possession they have perfected their rights and title.
After perusal of the orders passed by the Courts below it is clear that plaintiff appellant's suit was dismissed on the ground that the suit is barred by Section 49 of the UPCH Act. A perusal of the order of the trial Court also shows that in the concerned village consolidation operation were taken twice by the appellants have failed to put up their claim before the consolidation authorities. If the appellants have any right and title in respect of the disputed property they should have filed their claim before the consolidation authorities. Therefore, the learned trial Court and the appellate Court have rightly upheld that the suit of the plaintiff is barred by Section 49 of the UPCH Act.
(3.) SECOND appeal is not fit for admission and is dismissed accordingly. Appeal dismissed.;
