JUDGEMENT

(1.) ANJANI Kumar, J. By means of the present writ petition under Article 226 of the Constitution of India, petitioner challenges the orders dated 12-9-1997 and 17-11-1999, passed by Licensing Authority/district Magistrate, Meerut and Divisional Commissioner, Annexurea-5 and 8 to the writ petition, respectively, whereby the petitioner's fire-arm licence has been cancelled by the Licensing Authority and on appeal, the Appellate Authority dismissed the appeal filed by the petitioner.
(2.) HEARD learned Counsel appearing on behalf of the petitioner and learned Standing Counsel representing the respondents.
Learned Counsel for the petitioner has argued several points but this petition can succeed on the first point itself that the Appellate Authority has said in its order in last but one paragraph that the appellant has not produced any solid evidence, which may demonstrate that the cases, which are registered against him, have already been decided in his favour. In view of the list of the documents, which had been produced by the petitioner before the Appellate Authority, a copy of which is annexed as Annexure-7 to the writ petition, it is abundantly clear that this statement is incorrect. Therefore, this writ petition is allowed. The order dated 17-11-1999 passed by the Appellate Authority is quashed. The matter is remanded back to the Appellate Authority to decide the appeal of the petitioner afresh in accordance with law. The Appellate Authority is directed to decide the appeal of the petitioner afresh in accordance with law and in the light of the observations made in the judgment, which the petitioner shall produce before him along with the certified copy of this order, within a period of six weeks from the date of production of a certified copy of this order.
In view of what has been stated above, this writ petition is allowed. The order dated 17-11-1999, Annexure-8 to the writ petition, passed by the Appellate Authority is quashed. The Appellate Authority is directed to decide the petitioner's appeal afresh as observed above. W. P. allowed. .;
