JUDGEMENT

(1.) Heard learned counsel for the petitioner, learned Standing Counsel and also perused the record.

By means of this petition filed under Article 226 of the Constitution of India, petitioner prays for issuance of a writ, order or direction in the nature of certiorari quashing the order dated 24.01.2002 whereby the revision filed by the contesting respondents No. 4 to 25, for short 'the contesting respondents', against the order dated 29.7.1999 passed by the respondent No. 2 has been allowed.

It appears that the land in dispute was allotted to the contesting respondents after following the procedure prescribed under the law on 15.10.1986, which was also approved by the competent authority. Long thereafter a report is stated to have been submitted to the Tehsildar by the Revenue Officer who, in turn, placed the same before the respondent No. 2 for cancellation of the said allotment made in favour of the contesting respondents. The respondent No.2, without issuing any notice and without affording an opportunity of hearing to the contesting respondents and without following the procedure prescribed under the law, approved the said report by the order dated 29.7.1999 and cancelled the allotments made in favour of the contesting respondents. Challenging the validity of the said order, a revision was filed by the contesting respondents before the respondent No. 1. The respondent No 1. after hearing the counsel for the parties, recorded clear and categorical findings to the effect that the order was passed by the respondent No. 2 without following the procedure prescribed under the law, in violation of the principles of natural justice as well as in violation of the provisions of Section 198 of the U.P. Zamindari Abolition and Land Reforms Act. The same was, thus, wholly illegal and without jurisdiction. Having recorded the said findings the revision filed by the contesting respondents was allowed by the respondent No. 2 by the impugned order. Hence the present petition.;
