JUDGEMENT

(1.) I have heard the learned counsel for the petitioner and Sri S.K. Sharma representing the respondent. It is not disputed that the controversy involved in this petition has already been settled by this Court in Writ Petition No. 21943 of 1989, vide judgment dated 17-10-1990 and another writ petition No. 4834 of 1991 decided on 3-5-1991. Following these decisions and for the reasons stated in writ petition No. 4834 of 1991 decided on 3-5-1991 the petition is allowed with the direction to the respondents to consider the case of the petitioner for absorption on a post in the cadre of General Clerks provided he has attained proficiency and qualification for that post under the provisions of Apprenticeship Act 1961. It is made clear that the petitioner would be entitled to be considered only for the post for which he has attained the prescribed qualification. The absorption of the petitioner will, however, be subject to the availability of post for which the petitioner is qualified. It is, however, expected that the absorption of the petitioner shall be made on the basis of the seniority. The case of the petitioner for absorption shall be considered on the available vacancies before regular appointments are made against the post in accordance with Regulations. This order, however, does not preclude the respondents from admitting candidates for training in future in accordance with the relevant Service Regulations and to adopt the procedure for recruitment in accordance with law.
(2.) A copy of this judgment and order may be given to the learned counsel for the petitioner on payment of requisite charges within a week.;
