JUDGEMENT

(1.) Case has been taken up in the revised call. No one appears to press this petition.
(2.) Sri Babu Lal, learned Standing Counsel has produced before the Court a certified copy of the sale deed dated 11.8.2006 issued by the office of the Sub Registrar, Khurja whereby the land in dispute was transferred by Smt. Hooran in favour of Smt. Shanti Devi, respondent no.4. In the impugned order it has been categorically recorded that the land in question was resolved to be allotted to the petitioner vide resolution of the Land Management Committee on 23.1.1998 which was duly approved by the Deputy Collector on 27.6.1998. Although the allotment was of sirdari rights, but the petitioner transferred the said land allotted to her by means of sale deed dated 11.8.2006, in favour of respondent no.4. The Courts below have categorically recorded as the period of ten years had not expired, from the date of the settlement with the petitioner, she had no right to transfer the same and therefore, the transfer was hit by Section 152 of the U.P. Zamindari Abolition and Land Reforms Act. A Bhumidhar with non transferable rights having been allotted land would become a bhumidhar with transferable rights only on completion of ten years under the provisions of Section 131-B of the Act.
(3.) The stand taken in the petition before this Court is that the petitioner has not executed any sale deed and, therefore, the entire proceedings were vitiated. Now that the sale deed has been produced by the learned Standing Counsel no one has appeared on behalf of the petitioner. In view of the facts recorded, this petition lacks merit and is accordingly dismissed. Certified copy of the sale deed produced by the learned Standing Counsel is retained on record.;
