JUDGEMENT
-
(1.) THE present appeal has been filed against the judgment and order dated 27.1.05 passed by the learned Single Judge, whereby the writ petition filed by the Appellant seeking re -instatement in service on Class -III post in the Board of Revenue, Allahabad has been dismissed.
(2.) WE have heard Shri Narendra Mohan, learned Counsel for the Appellant and perused the judgment dated 27.1.05 passed by the learned Single Judge giving rise to the present appeal, the grounds taken in the memo of appeal and the documents filed along with it. Shri Narendra Mohan, learned Counsel submitted that the Appellant was entitled to re -instatement as his juniors are continuing in the job. Be that it may, we may mention here that the Appellant's father was the Registrar, who appointed his own son on Class -III post on daily wages in October 1994 and on which post he continued till April, 1996. Thereafter, his engagement was revoked. Learned Single Judge has dismissed his petition stating that the appointment was made without due process and law. Even otherwise also, it is a Class -III post and clear favoritism has been done in this case by a father, who happened to be the Registrar, appointing his own son on a Class -III post.
(3.) THIS Court does not find any infirmity in the order passed by the learned Single Judge.;
