JUDGEMENT

(1.) Heard learned counsel for the petitioners, learned Standing Counsel and also perused the record.

By means of this petition filed under Article 226 of the Constitution of India, petitioners pray for issuance of a writ, order or direction in the nature of certiorari quashing the order dated 27.9.1983 passed by the Settlement Officer, Consolidation and the order dated 21.9.1990 passed by the Deputy Director of Consolidation.
(3.) It appears that in the village, where the land in dispute is situated, came under the consolidation operation. In the basic year, the land in dispute, i.e., Khata No. 27, was recorded in the names of Bechan and Vindhyachal, sons of Dal Singar. Shiv Poojan respondent No. 3, filed an objection for expunging the names of Bechan and Vindhyachal. It was pleaded that the said persons got their names illegally mutated in the revenue records. They had no concern with the land in dispute, therefore, the names were liable to be expunged. The objection filed by the contesting respondent was contested by the petitioners, who pleaded that Suit No. 206 of 1963, under Section 229-B of the U.P. Zamindari Abolition and Land Reforms Act, was decided in favour of the petitioners on 10.4.1962 by the Sub-Divisional Officer. On the basis of the said decision, the names of the petitioners, Vindhyachal and Bechan, were recorded and they have been continuing in possession over the same. The objection filed by the contesting respondent was, therefore, liable to be dismissed.;
