JUDGEMENT

(1.) Heard learned counsel for the parties and perused the record.
(2.) By means of this petition, the petitioners pray for issuance of writ, order or direction in the nature of certiorari quashing the judgment and orders dated 18.7.1990 and 15.1.1987 passed by respondents No. 1 and 2 respectively.
(3.) It appears that a suit for specific performance of contract of sale was filed by Sri Ramesh Chandra - respondent No.3. The said suit was decreed ex-parte. Thereafter an application under Order IX Rule 13 C.P.C. was filed by the respondent No. 3. The said application was objected to and opposed by the applicants and was ultimately dismissed by the trial court. Challenging the validity of the said order an appeal was filed before the appellate court. The said appeal was also dismissed. The defendants thereafter approached this Court and filed Writ Petition No. 5644 of 1984 challenging the validity of the order passed by the appellate court. In the meanwhile, mutation proceedings were initiated by the contesting respondents in which orders were passed by the authorities concerned in favour of the respondents. Challenging the validity of the said orders Writ Petition No. 21282 of 1990 was filed by the petitioners. The said writ petition came up for hearing. However, the same could not be heard as earlier petition filed against ex-parte decree was pending disposal in this Court. Subsequently it has been admitted by the parties that Writ Petition No. 5644 of 1984 was dismissed by this Court on 2.5.94. Challenging the judgment and decree passed by this Court an S.L.P. was filed in Hon'ble Supreme Court. The said S.L.P. was also dismissed on 3.2.1995. Thus the judgments and orders passed by the Courts below, this Court and the Supreme Court have become final. This petition, in my opinion, has become infructuous and the same is also liable to be dismissed.;
