JUDGEMENT

- (1.) Heard Sri Radhey Shyam Dwivedi, learned counsel for the petitioners, learned standing counsel for the respondent nos. 1, 3 and 4 and Sri Kaushalendra Nath Singh, learned counsel appearing for the respondent no. 2.

This writ petition has been filed by the petitioners with the following prayers : "(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to protect the petitioners from eviction by the respondents from their site of squatting/vending as per the mandate of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 as well as notification dated 15.06.2017 of the Chief Secretary for implementation of Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. (ii) Issue a writ, order or direction in the nature of mandamus directing the respondents not to dispossess or evict or disturb the petitioners from their site of vending at Sector-2 and 14 Noida Gautam Buddha Nagar U.P. till the certificate or license is granted to the petitioners as per Section 3 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. (iii) Issue a writ, order or direction in the nature of mandamus directing the respondents to protect the petitioners till the respondents frames the rules, schemes etc. alongwith the constitution of TVC and demarcation of vending and non vending zone and grant of license as per the eligibility and merits for their interrupted and peaceful vending. (iv) Issue any other writ, order or direction, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. (v) Award the cost of the writ petition in favour of the petitioners."

It is contended by the learned counsel for the petitioners that the issue involved in this writ petition was subject matter of another writ petition namely Writ C No. 28417 of 2019 which was finally disposed of by another co-ordinate Bench of this Court by order dated 17.09.2019 and hence this writ petition may also be disposed of on the same terms and conditions subject to which the aforesaid writ petition was decided.;
