- (1.) Heard Sri Vinay Kumar Mishra, learned counsel for petitioner and learned Additional Government Advocate appearing on behalf of respondent no. 1 to 3.

This writ petition has been filed with a prayer to issue a writ of certiorari to quash First Information Report (hereinafter referred to as 'FIR') dated 10. 07. 2017 registered as Case Crime No. 0326 of 2017, under Section 3 / 7 of Essential Commodities Act, 1955 (hereinafter referred to as 'Act, 1955'), P. S. Pataherwa , District Kushinagar.
(3.) Learned counsel for petitioner submitted that Act, 1955 will not apply in respect of offences which are punishable under Legal Metrology Act , 2009 (hereinafter referred to as 'Act, 2009') and he has placed reliance on Section 51 of Act, 2009.;
