- (1.) Heard Praveen Kumar Srivastava, learned counsel for the applicants, learned counsel for opposite party no.2 and the learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been filed to quash the summoning order dated 31st January, 2019 as well as the entire proceedings of Complaint Case No. 43819 of 2018 (Case No. 2128 of 2019) (Shikaha Pandey Vs. Udit Kumar Pandey and Others), under Sections 498-A , 323 , I.P.C . and Sections 3/4 D.P. Act, Police Station-Barra, District-Kanpur Nagar, pending in the Court of Special Chief Judicial Magistrate, Kanpur Nagar.
(3.) On 30th April, 2019, a Coordinate Bench of this Court passed following order: "Heard learned counsel for the applicants and learned A.G.A. for the State. It is submitted by learned counsel for the applicants that the present matter relates to a matrimonial dispute between husband and wife and the said matter can be well considered by Mediation Centre of this Court. It is directed that applicants shall deposit a sum of Rs.15,000/- within two weeks' from today with the Mediation Centre out of which 90 % amount shall be paid to opposite party no.2 for her appearance before the Mediation Centre. The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of two months after giving notices to both the parties. Thereafter the case shall be listed before appropriate Bench. Till the next date of listing proceeding of complaint case no. 43819 of 2018 (Case No. 2128 of 2019) Shikaha Pandey Vs. Udit Kumar Pandey and other under section 498-A , 323 I.P.C. and section 3/4 of D.P. Act P.S. Barra district Kanpur Nagar shall remain stayed. After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this petition shall stand dismissed automatically." ;
