- (1.) Heard Sri H.N. Singh, learned Senior Advocate assisted by Sri I.K. Upadhyay, learned counsel for the petitioners, Sri Kunal Shah, learned counsel for the respondent Warehousing Corporation and learned Standing Counsel for respondent no.1 and perused the record.

The contention advanced by the learned counsel for the petitioner is that in spite of the offer made by the petitioner being the lowest @ rate of 137%, the same has come to be rejected on the ground that earlier one Shri Ratan Kumar Singh worked on ad-hoc basis @ 81% and so this time offer was too much, whereas in matter of one Ravindra Kumar Singh relating to centre Chandauli-II, ASOR offered by him is almost double of 81%, and yet the tender of the said person has come to be accepted. It is further alleged that no justifiable reasons assigned for fixing ASOR as 239% to 340% for various centres under the new Notice Inviting Tender.
(3.) From the perusal of the documents brought on record by the petitioner in the writ petition and the pleadings raised, the argument advanced by learned Senior Advocate prima facie appears to be correct and the matter requires consideration.;
