JUDGEMENT
PANKAJ BHATIA,J. -
(1.) The present petition has been filed challenging the order dated 24.1.2009, whereby the representation filed by the petitioner was rejected as well as seeks a writ in the nature of mandamus commanding the respondents to declare the result of the petitioner of High School Examination-1986 forthwith and to issue the requisite certificate pertaining to Roll No. 0747995.

The brief facts of the present case are that the petitioner appeared in the High School Examination-1986 conducted by the Board of High School and Intermediate Education and was given Roll No. 0747995. The petitioner states that he passed the said examination and was issued a mark-sheet, which is contained as Annexure-2 to the writ petition certifying that the petitioner has obtained 288 marks out of 600 marks and is qualified the examination in Second Division. It is further stated that thereafter the petitioner appeared in the regular examination for Class-12th examination conducted by the same Board and passed the Class-12th examination in the year 1989 with a Second Division and was issued a mark-sheet, which is annexed a Annexure-3 to the petition. The petitioner contends that on the basis of the said mark-sheet, petitioner obtained employment, however, it appears that some orders were passed cancelling the examination of the High School in which the petitioner had appeared for the year 1986, however, the petitioner claims that he was never communicated the said order nor was he intimated or called upon prior to passing of any such order.
(3.) As the petitioner has not received the certificate and had only received the mark-sheet, he approached this Court by filing Writ Petition No. 65633 of 2008 ( Kapil Muni v. State of U.P. and Others ) alleging that in normal practice the Board sends the certificates much after the declaration of results and and the candidates are handed over the certificates by the Principal and this process generally takes time, however, despite the petitioner having qualified, his certificate was not being issued. This Court disposed off the writ petition vide order dated 18.12.2008 directing the petitioner to approach the Secretary of the Board, who was in turn directed to take appropriate decision redressing the grievance of the petitioner in terms of the directions issued by this Court on 18.12.2008.;
