JUDGEMENT

(1.) Heard Shri Abhishek Tandan, learned counsel for the applicants alongwith Shri Manu Srivastava, Advocate and Shri Prashant Vyas, Advocate; and Shri K.R. Singh, learned Additional Chief Standing Counsel as well as Shri Sanjay Kumar Singh, learned Additional Chief Standing Counsel for the State.
(2.) The present matter has been taken up in the midst of Dushhehra Vacation on the Extreme Urgency Application no.2 of 2020 moved on behalf of applicant. The said application was placed before me on the evening of 24.10.2020 on which oral permission was accorded. Thereafter on the order of Hon'ble the Chief Justice dated 25.10.2020, the matter is placed before this Court today itself.

The applicant is before this Court for a direction to initiate contempt proceeding against the respondents for disobedience of the order dated 20.09.2019 passed in Writ Petition No.30270 of 2019 (Lalit Mohan Gupta and another vs. State of U.P. and Ors.). For ready reference, the relevant extract of order dated 20.09.2019 is quoted as under:-
"1. Supplementary affidavit filed today is taken on record.
2. Sri Anil Kumar Mehrotra, Advocate, assisted by Sri Manu Srivastava, learned counsel appearing for petitioner stated that petitioner has submitted an objection/reply to impugned show cause notice dated 6.7.2019.
3. In our view, respondent/competent authority should consider the same, pass appropriate oder after considering aforesaid reply and then proceed in accordance with law.
4. Learned Standing Counsel also fairly stated that respondent/competent authority shall pass appropriate order after considering objection/reply of petitioner.
5. In view of above, this writ petition is disposed of finally at this stage directing respondent/competent authority to pass appropriate order after considering petitioner's aforesaid reply within two months from the date of production of certified copy of this order. Till then, execution of impugned notice shall remain suspended." ;
