JUDGEMENT

(1.) HEARD Sri Siddharth Khare, learned Counsel for the petitioner and learned Standing Counsel appearing for the respondent Nos. 1 to 5.

THROUGH this writ petition, the petitioner has assailed an order passed by Assistant Director of Education, Azamgarh Region, Azamgarh on 12.2.2008 by which the said authority had declined to correct the entry regarding Date of Birth of the petitioner and treated him to have retired from services on 1st January, 2004. He has placed reliance on a transfer certificate issued by Head Master of a Primary School in preference to the duly verified and duly stamped service book prepared at the time of entry in the services and maintained by the Office of Chaudhary Charan Singh Junior High School, Salahabad, Mau. Later on the petitioner was duly confirmed in the services on 28.6.1985 and the approval was also accorded by the B.S.A., Azamgarh vide order dated 16th November, 1985. The service book has been annexed by the petitioner as annexure No. 9 to the writ petition which runs in about 10 pages. This contains all the relevant events which took place in the services career of the petitioner, like, confirmation, awarding increment and allowing promotional scale etc. According to the learned Counsel for the petitioner, the petitioner entered in the services of the institution as a Class -IV employee on 28th June, 1981. The approval was accorded by Basic Siksha Adhikari, Azamgarh vide order dated 16th November, 1985. The service book of the petitioner was prepared by the Office of the said institution on 28th June 1981 signatures and thumb impression of the petitioner were obtained on the first page of the service book. The signatures and other contents were duly verified by the Principal of Chaudhary Charan Singh Junior High School, Salahabad, Mau. The Date of Birth was recorded as 1st March, 1954 in the service book.

AS per learned Counsel for the petitioner the service book is prepared by the concerned Department and the details about Government Public Servant are recorded in the service book as per provisions contained in Civil Service Regulations and instructions issued under Fundamental Rules, Financial Handbook Volume II to IV.;
