JUDGEMENT
Prakash Krishna, J. -
(1.) Heard Sri S.C. Mandhyan, learned counsel for the petitioners and Sri D.V. Jaiswal, learned counsel for the contesting respondents. By means of the present writ petition, the petitioners have sought a writ, order or direction in the nature of Certiorari for quashing of the orders dated 31st of May, 2000 and 27th of September, 1993 passed by the Board of Revenue, U.P. at Allahabad. The facts of the case so far as necessary for disposal of the present petition may be noticed in brief.
(2.) It appears that the petitioners filed a revision No.33 of 1992 : Vijai Kumar and another v. Rajiv Srivastava and others before the Board of Revenue, U.P. at Allahabad. In the said revision, an order for taking steps was passed. The petitioners failed to take any step and the revision was dismissed by the order dated 27th of September, 1993. It is mentioned therein that the case was called out several times but none was present nor process fee and notice were filed. To recall the said order, an application was filed on 4th of April, 2000. The said application having been dismissed by the impugned order, the present writ petition has been filed.
(3.) The learned counsel for the petitioners submits that the petitioners could not take steps due to the fault of the clerk of their counsel. The petitioners should not be made suffer on account of lapse on the part of the clerk of their counsel. The learned counsel for the contesting respondents supports the impugned order.;
