JUDGEMENT
Rakesh Sharma, J. -
(1.) This writ petition is of the year 1981, that is, more than 29 years have passed. Though, this case has been listed several dates, but could not be taken up for one reason or the other. The hearing could not commence and the dispute could not be resolved. Today, the case has came up for final hearing today.
(2.) The dispute was raised before the Consolidation Officer in the year 1974. The Consolidation Officer passed an order on 13.3.1974 thereby equal shares were allocated to the petitioner and opposite parties no. 3 and 4. However, allegations have been made that the record was interpolated and incorrect entries were made in the consolidation records. Since the opposite parties no. 3 and 4 were denied their due share, they preferred an appeal before the A.S.O.C. This appeal was allowed and the matter was remanded back to the Consolidation Officer for taking a fresh decision. Before the Consolidation Officer, the petitioners took a turn around and claimed entire land in dispute. The C.O. had ignored the earlier findings and the essence of litigation, allowed the petitioner to have the whole land cultivated by Khushal.
(3.) An Appeal was preferred by the opposite parties no. 3 and 4. and the same was allowed by which half share was allocated to the contesting parties after dividing the land holding of Khushal. A Revision was preferred before the D.D.C., the revisional court has affirmed the findings of S.O.C.;
