- (1.) ON last date i.e. 03.02.2010 of hearing, we passed the following order: Pursuant to our order dated 25.01.2010, the detenue/petitioner Ranjana Chaurasiya has been produced in court. She states that she is studying in graduation and her age is presently about 16 years. However, the medical report suggests her age to be about 18 years. From appearance, she does not seem to be a minor and she also states to have been working in some employment. Taking into account the totality of circumstances, we deem it appropriate to direct the appearance of her parents, and of her friend/ paramour/husband Irshad and his parents in court on the next date of hearing. List on 08.02.2010. Let a copy of this order issue to learned Government Advocate for immediate compliance. Senior Superintendent of Police and Chief Judicial Magistrate, Lucknow shall ensure compliance of this order. The detenue shall remain lodged in Nari Niketan, where she is presently staying and shall be produced in court on the next date of listing.
(2.) PURSUANT to the said order, mother of petitioner detenue, Irshad to whom she claims to have legally wedded and his parents are present in Court. On being asked, the detenue appears to be firm in her decision that she being a major wants to stay with Irshad. In the High School Marks Sheet, her date of birth has been recorded as 02.06.1993, thus, presently she is above 16 years.
(3.) WE have noticed in the above order that the medical certificate suggests her age to be about 18 years. Thus, taking into account the margin of error of 2 years' on either side, she is a major to take decisions about her future.;
