JUDGEMENT

(1.) Heard Sri Anup Kumar Mishra, learned counsel for the petitioners, Sri R.J. Trivedi, learned counsel for the opposite party no. 2, learned Standing Counsel and perused the record.
(2.) This writ petition under Article 226 of the Constitution of India has been filed with the prayer that a writ, order or direction in the nature of certiorari may be issued quashing the impugned order dated 12-04-2010 passed by the Deputy Director of Consolidation, Sitapur, contained as Annexure No. 3 to the writ petition.
(3.) Learned counsel for the petitioners has submitted that a will deed was executed by the deceased, Sirajuddin in favour of Fatima, who was not his wife and the deceased has not executed any will deed in favour of his wife, Sakuna and hence, deceased's daughter, Smt. Sarbari cannot claim inheritance on the basis of the said will deed. He has further submitted that the petitioners are the nephews of the deceased, Sirajuddin and they had inherited the property of the deceased. His contention is that the Deputy Director of Consolidation has committed illegality in allowing the revision and setting aside the orders of the court below dated 28-07-2006 and 04-11-2009 and hence, the impugned order dated 12-04-2010 deserves to be set aside.;
