- (1.) WE have heard learned AGA and have perused the judgment of acquittal dated 24.12.2003 passed by Additional Sessions Judge/Special Judge (Anti -corruption), Gorakhpur in S.T. No. 29 of 1991 (State v. Suryanath Pasi and Ors.), under Sections 147, 148, 323, 324, 307 and 302 I.P.C., Police Station Khajani, District Gorakhpur.
(2.) LEAVE to appeal is granted. Admit.
(3.) ISSUE bailable warrant of arrest against the accused -respondents namely Surya Nath Pasi son of Dudhai Pasi, Satya Sahab son of Surya Nath Pasi, Ram Harakh son of Surya Nath Pasi, Murali son of Ram Subhag, Mangal son of Ramsevak, Kripal son of Ram Awadh, Ram Sanjan son of Panchu, Ram Asrey son of Samesar, Deena alias Ramdeen son of Ram Awadh, Galur alias Chandra Bhushan son of Panchu, Thothi son of Dudhai and Sri Ram Pasi son of Chouthi returnable within three weeks through Chief Judicial Magistrate, Gorakhpur, who is directed to get the bailable warrant served on the aforesaid accused respondents. If the aforesaid accused respondents appear and/or surrender before C.J.M., Gorakhpur, he is directed to release them in S.T. No. 29 of 1991 (State v. Suryanath Pasi and Ors.), under Sections 147, 148, 323, 324, 307 and 302 I.P.C., Police Station Khajani, District Gorakhpur, on their furnishing a personal bond of Rs. 20,000/ - and two sureties each in the like amount to the satisfaction of the court below.;
