JUDGEMENT

(1.) SUDHIR Narain, J. The writ petition is directed against the order dated 9-11-1993 passed by the Prescribed Authority allowing the release application and the order of the Appellate Authority dated 14-12-1999 dismissing the appeal against the aforesaid order.
(2.) THE landlord-Respondent No. 3 filed an application for release of the dis puted shop with the allegations that he had completed his M. B. B. S. examination and is unemployed and needed the shop in question for his clinic. THE petitioner con tested the application and denied that the need of the landlord was bona fide. THE Prescribed Authority, considering the en tire material evidence on record, recorded a finding that the need of the landlord was bona fide as he required the shop for his clinic. THE petitioner preferred an appeal and the same has been dismissed by the Appellate Authority on 14-12- 1999.
I have heard Sri A. K. Mishra, learned Counsel for the petitioner and Sri Rajesh Tandon, learned Counsel for the contesting respondent.
Learned Counsel for the petitioner has assailed the findings recorded by the authorities below. It has been found that the respondent required the shop for his clinic. It has not been shown that the landlord owns any other suitable accom modation.
(3.) I do not find that there is any manifest error of law. The writ petition is, accordingly, dismissed.
In the end, learned Counsel for the petitioner prayed that some time may be granted to the petitioner to vacate the disputed premises. Considering the facts and circumstances of the case, the petitioner is granted ten months time to vacate the disputed premises provided he gives an undertaking on affidavit before the Prescribed Authority within two weeks from today that he would vacate the dis puted premises within the time granted by this Court and would hand over its peace ful possession to the landlord-Respondent No. 3. Let a certified copy of this order may be made available to the learned Counsel for the parties on payment of usual charges within three days. Petition dismissed. .;
