JUDGEMENT

(1.) THIS writ petition is directed against the order dated 4 -11 -1989 passed by the appellate authority remanding the case to the Prescribed Authority. The landlady - -Respondent No. 3 filed an application for release of the disputed accommodation under Section 21(1)(a) of the U.P. Act No. XIII of 1972 alleging that the disputed accommodation is in a dilapidated condition and requires demolition for the purposes of re -construction.
(2.) THE petitioner contested the said application and denied that the disputed accommodation was in a dilapidated condition requiring demolition. The Prescribed Authority rejected the application by its order dated 27th June, 1985. Felt aggrieved against the order, the landlady filed an appeal against the same before the appellate authority. The appellate authority after reconsidering the case of the respective parties remanded the matter to the Prescribed Authority to consider the matter afresh in accordance with law. In view of the observations made above and from a perusal of the impugned order, I find that the appellate authority has rightly remanded the matter to consider the nature of the accommodation after making spot inspection etc. and considering the evidence on merits. I do not find that it is a fit case for interference under Article 226 of the Constitution.
The writ petition is accordingly dismissed.
