JUDGEMENT
R.H. Zaidi, J. -
(1.) By means of this petition filed under Article 226 of the Constitution of India petitioner challenges the validity of the order dated 2.2.2000 passed by the respondent No. 2 holding that the Civil Court has no jurisdiction to entertain and decide the suit and the order dated 16.5.2000 whereby revision filed by the petitioner against the order passed by the trial Court has been dismissed.
(2.) It appears that contesting respondent No. 3 filed a suit for ejectment and recovery of rent before the respondent No. 2 claiming that the provisions of U.P. Act No. 13 of 1972 has no application on the building in dispute as construction of the building was completed on 1.4.86. The petitioner on receipt of the notice from the trial Court filed her written statement pleading that the provisions of the Act were fully applicable over the building in question as the same was an old building. The trial Court, therefore, had no jurisdiction to entertain the suit.
(3.) The trial Court after hearing the parties and examining the record came to the conclusion that the construction of the building was completed on 1.4.86 when the first assessment order was passed in respect of the said building by the competent authority. The petitioner has challenged the validity of the order dated 2.2.2000 before the Revisional Court. The Revisional Court has dismissed the revision as not maintainable, hence the present petition.;
