JUDGEMENT

(1.) The relief sought for in this writ petition is for a direction to the respondent to consider the representation submitted by the writ petitioner on 14.9.2013.

The learned counsel appearing for the writ petitioner made a submission that the father of the writ petitioner Late Mr.Sekar was working as Sweeper in the office of Villupuram State Transport Corporation. The father of the writ petitioner was passed away on 05.5.2001, while he was in service. However, the representation seeking appointment on compassionate grounds was originally submitted by the mother of the writ petitioner on 27.5.2011 and thereafter by the writ petitioner on 14.09.2013.

At the outset, the fact remains that the deceased employee passed away on 5.5.2001 and the first application seeking compassionate appointment was submitted by the wife of the deceased employee on 27.5.2011, after a lapse of about ten years and the writ petitioner submitted an application on 14.9.2013, after a lapse of twelve years from the date of death of the deceased employee. Thus, such a belated representations seeking the benefit of scheme of compassionate appointment cannot be entertained, in view of the terms and conditions of the scheme. Even, as per the Government Order in this regard, an application seeking compassionate appointment ought to have been submitted within a period of three years from the date of death of the deceased employee. Even though the deceased employee passed away in the year 2001 and now after a lapse of about fifteen years the benefit of scheme of compassionate appointment cannot be extended in view of the legal principles settled by the Apex Court in this regard.;
