JUDGEMENT

(1.) The petitioner has come forward with this Writ Petition to direct the respondents to consider him for compassionate appointment as Junior Assistant either in the second respondent Department or in some other Department in the light of the Guidelines issued by the first respondent in the form of G.O.Ms.No.314 Department of Labour dated 13.11.1991.
(2.) The father of the writ petitioner who was working in the second respondent Department at Government Primary Health Centre, Kabistalam, Siddha Wing, Tiruvarur District. On account of the accident, he died on 13.11.2003. Unfortunately, the petitioner's mother also died on 01.07.2009. The family was in indigent circumstances and the Application seeking compassionate appointment was submitted by the writ petitioner on 24.4.2006.

It is an admitted fact that though the Application seeking compassionate appointment was submitted on 24.04.2006, the Writ Petition was filed only on 18th December, 2015, after a lapse of nine years. Thus, the Writ Petition is liable to be rejected on the ground of laches. When the family of the writ petitioner is able to get along with their life well for more than 14 years from the date of death of the deceased employee, the indigent circumstances prevailed during the relevant point of time vanished. Thus, the question of considering the grant of appointment on compassionate ground at this point of time will not arise at all. This Court has taken note of the fact that the mother of the writ petitioner also died and the writ petitioner is now aged about 29 years and it is for him to participate in the 'Open Competition' process and get employment as per his wishes. This Court can only wish the writ petitioner for his future prospects and he has to work hard and acquire all good things in his life by putting more efforts.;
