(1.) WE have heard Shri S.B. Khayalia for the petitioner and Shri V.B.K. Jain for the first respondent.
(2.) The main grievance made in the application is regarding the delay on the part of first respondent to give its concurrence for laying down of pipeline for supply of gas at Kawas and Gandhar Gas Power Stations by Gujarat State Petroleum Corporation Ltd (GSPC). We have been informed that GSPC has been pursuing with the first respondent since 2002 for its permission to lay gas pipeline for supply of gas to Kawas and Gandhar GPS. We have been informed that it was only on 16.8.2005 that the permission was granted. The necessary details in this regard are not available on record. We, therefore, direct the petitioner to place on record the letters written by the petitioner/GSPC since 2002 to the first respondent for its concurrence/permission and first respondent's reply there to, if any.
The first respondent is directed to file the following details:
(a) Grid map showing gas supply for Kawas GPS and Gandhar GPS,
(b) Changed circumstances leading to grant of permission to GSPC in August 2005, for laying of the gas pipeline.
(3.) THE affidavits shall be filed by the parties latest by 10.12.2005, with a copy to other parties in the petition.;
