(1.) HEARD the representatives of the parties present at the hearing.
(2.) The petitioner has sought approval of incentive, for Malda Auto Transformer, among other transmission assets. According to the first petition, the incentive for Malda Auto Transformer is to be borne by WBSEB. However, in response to an objection to that effect filed by WBSEB, the petitioner in its rejoinder dated 26.9.2002 in Petition No. 89/2002 stated that as per EREB decision, incentive for Malda Auto Transformer for the period 1.4.2001 to 30.9.2001 is payable by WBSEB and thereafter it is to be shared by all constituents of Eastern Region. However, in its affidavit verified on 8.9.2005 and filed on 9.9.2005, the petitioner has stated that the incentive for the year 2001-02 for Malda Auto Transformer shall be borne by WBSEB. When this discrepancy was pointed out to the representative of the petitioner, he stated that as per the decision of EREB, the transmission charges in respect of Malda Auto Transformer are to be borne by all the beneficiaries in the Eastern Region with effect from 1.10.2001 though, as per the tariff for the period 2001-2004 as approved by order dated 30.6.2003 in Petition No. 64/2002, the transmission charges are to be borne by WBSEB only. The representative of the petitioner submitted that a fresh petition would be filed for a direction that the tariff for Malda Auto Transformer for the period from 1.10.2001 onward should be shared by all the beneficiaries in the Eastern Region.
In view of the above stated position, the present petitions for approval of incentive cannot be taken up at this stage. These petitions are adjourned sine die and may be taken up for consideration after a decision on the fresh petition being filed by the petitioner, in view of the statement of the representative of the petitioner recorded above.;
