JUDGEMENT

(1.) The present Petition is filed by Shri Tukaram Shankar Narwade seeking compensation for damages caused by PGCIL while erection of towers of the transmission line on his
land by PGCIL as per Section 12(2. and 12(3. of the EA 1910 and under Section 67 of
the Electricity Act 2003 read with Works of Licensees Rules 2006 and the Maharashtra
Electricity Works of Licensees Rules, 2012.
(2.) The prayers of the Petitioners are as under:
A. The Petition may kindly be allowed. B. That, the impugned Order passed by the District Collector order dated 03.01.2014 in application no. 17/2012 may kindly be quashed and set aside. C. Any other suitable and equitable relief may kindly be granted in favor of the petitioner."
(3.) Back Ground facts:
3.1 PGCIL, a Central Transmission Licensee, has erected the towers of 400kV Wardha Parali Double Circuit Transmission Line on the land of the Petitioner at Gut. No. 259 of Thorava village, Dist. Hingoli.
3.2 The Respondent No.1, PGCIL, had paid the compensation to the Petitioner for damage to the crop and trees at the time of execution of the work. i.e. foundation work, tower erection and stringing of conductor.
3.3 Total compensation paid by the PGCIL to Petitioner is Rs.43, 295/ -(Rs. Forty Three Thousand, Two Hundred and Ninety Five only..
3.4 Being aggrieved by the compensation paid by PGCIL, Petitioner had filed the application No 17/2012 before the District Collector, Hingoli requesting for enhancement of the compensation and compensation for damage to the land due to erection of the towers.
3.5 After hearing both the parties, the District Collector, Hingoli passed the Order No.17 on 3 January, 2013, with following directions :
"The Application filed by Shri Tukaram Shankar Narwade, R/o Thorava Dist. Hingoli is dismissed as lack of powers. This is informed to all and case is closed."
3.6 Aggrieved by the aforesaid Order passed by the District Collector, Hingoli, Petitioner has filed the Petition before the Commission on 30 January, 2013. ;
