(1.) This appeal, preferred under Section 28 of Hindu Marriage Act, 1955, is directed against judgment and order dated 10.01.2011, passed by Additional District Judge/3rd Fast Track Court, Haridwar, in Hindu Marriage Act Petition No. 08 of 2008, whereby said court has dismissed the petition filed by the husband (petitioner Rohit Sandil), and declined the decree of divorce.
(2.) Heard learned counsel for the appellant, and perused the lower court record. No one turned up on behalf of the respondent in the appeal even after being sufficiently served.
(3.) Brief facts of the case are that petitioner/appellant Rohit Sandil filed a petition under Section 13 of Hindu Marriage Act, 1955, before the District Judge, Delhi, on 04.01.2008. It appears that on the application of the respondent Priyanka Sandil, vide order dated 29.09.2008, passed by the Apex Court on Transfer Petition (Civil) No. 302 of 2008, the case was transferred to the court of District Judge, Haridwar, for its disposal.;
