(1.) By means of this petition moved under Section 482 Cr. P.C., the applicants/petitioners seek to quash the summoning order dated 07.12.2012 (annexure 7 to the affidvit ) passed by Judicial Magistrate, Rudrapur, U.S.Nagar in connection with Complaint Case No. 1209 of 2012, Harpreet Kaur vs. Amardeep Singh and others, under Sections 498-A, 323, 452, 506 IPC and Dowry Prohibition Act. A further prayer has been made to quash the entire proceedings of the said case.
(2.) At the very outset, it is contended on behalf of the applicants that the dispute between the parties is of matrimonial nature. It is also submitted that the dispute has amicably been settled between the parties as they have entered into compromise outside the Court and respondent Smt. Harpreet Kaur (victim) does not wish to proceed with the case filed against the applicants/petitioners. Lastly, it was submitted that the respondent has filed an affidavit before this Court seeking compounding of the offences on the basis of compromise arrived at between the parties.
(3.) A Compounding Application No. 311 of 2013 has been filed by the complainant/respondent wherein Amar Deep Singh (husband) and Smt. Harpreet Kaur (wife, victim) indicated that they have settled their differences amicably. Smt. Harpreet Kaur, in paragraph 3 of the affidavit, accompanying the Compounding Application has stated that she has amicably settled her dispute with her husband and other family members. She is not interested in continuing the criminal proceedings before the court below. Complainant-respondent Smt. Harpreet Kaur is present in person before the Court duly identified by her counsel. She stated that she does not want to proceed with the criminal prosecution lodged against the applicants/petitioners.;
