JUDGEMENT

- (1.) The applicant, by means of present application / petition under Section 482 of Cr.P.C., seeks to quash the charge-sheet dated 09.11.2009 and summoning order dated 09.12.2009, as also the entire proceedings of criminal case no. 9745 of 2009, State vs Jaspreet Singh, under Sections 498-A, 323, 504, 506 of IPC and Section of the Dowry Prohibition Act, pending in the court of Judicial Magistrate, I Class, Dehradun.
(2.) An FIR was lodged by complainant (respondent no. 2 herein) against three accused persons, including the applicant, on 20.08.2009, at police station Nehru Colony, District Dehradun, which was registered as case crime no. 136 of 2009, under Sections 323, 504, 506, 498-A of IPC and Section of the Dowry Prohibition Act. After the investigation, a charge-sheet was submitted against the accused-applicant Jaspreet Singh (husband) only. Cognizance was taken and accused was summoned to face the trial for the selfsame offences. Aggrieved against the same, present application under Section 482 of Cr.P.C. was moved.
(3.) None is present for respondent no. 2, despite personal service of notice upon her. No counter affidavit is filed by the said respondent either.;
