(1.) Delay condonation application no.1505/2013 for condoning the delay in filing the restoration application no. 149/2013 is filed. The same is not opposed. Reasons shown for delay are sufficient. The delay condonation application is allowed. The delay in filing the restoration application is condoned.
(2.) Also heard on restoration application no.149/2013. The same is also not objected. Grounds shown in the restoration application are sufficient. Restoration application is allowed. The order dated 17.05.2013 is recalled and the present application under Section 482 Cr.P.C. is restored to its original number.
(3.) Applicant, by means of present Application under Section 482 Cr.P.C., seeks to quash the summoning order dated 27.07.2010 passed by the Additional Judicial Magistrate, Rishikesh, District Dehradun in Case No.1205/2010 titled as Smt. Deepa Sharma vs. Setu Sharma & others under Sections 498-A, 323, 504 I.P.C. The applicant also seeks to quash the proceedings of the aforementioned criminal case pending before the said court.;
