JUDGEMENT

- (1.) This Criminal Appeal arises out of a judgment and order of the trial court dated 18.12.2003 passed by the learned Additional District and Sessions Judge/First Fast Track Court, Haridwar in Sessions Trial No. 202 of 1997 convicting the present appellants under Section 363/366/376 (2) IPC and thereby sentencing them for 7 years of rigorous imprisonment under Section 363 IPC, 10 years of rigorous imprisonment under Section 366 IPC and 10 years of rigorous imprisonment under Section 376(2) IPC and fine of Rs. 5000/- each, and in default in payment of fine further simple imprisonment for three months.
(2.) Since in this case the appellants were not being represented by any counsel at the time of final hearing, this Court appointed Mr. M. K. Chand as Amicus Curiae in the matter who has assisted this Court. He was given the paper book and time to prepare the matter.
(3.) The State is being represented by Mr. Sohail Siddiqui AGA with Ms. Meena Bohara, Brief Holder.;
