JUDGEMENT

- (1.) PW1 Deewan Ram wrote a complaint to Patti Patwari, Baggar, District Nainital against 5 accused persons, namely, Pratap Singh, Govind Singh, Prem Singh, Mahendra Singh and Nain Singh on 19.10.2001, which was registered as case crime no.6/2001 under Sections 147, 323, 504 IPC and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
(2.) Investigation began on the basis of said first information report. After investigation of the case, a charge-sheet was submitted against 3 accused persons, namely, Pratap Singh, Prem Singh and Govind Singh for the selfsame offences.
(3.) The case was committed to the Special Judge / Sessions Judge. When the trial began and prosecution opened it's case, charges against the accused persons (Pratap Singh, Prem Singh and Govind Singh) were framed for the offences punishable under Sections 323, 149 IPC & Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, to which they pleaded not guilty and claimed trial.;
