JUDGEMENT

- (1.) Heard learned counsel for the revisionist, learned AGA the State and perused the papers on record.
(2.) Upon a complaint filed by Smt. Kunti Devi, mother of the victim, an FIR as regards offence punishable under Section 376 (2) (f) IPC was registered in PS Champawat, District Champawat on 23.12.2012 against accused Anand Singh The occurrence took place on 22.12.2012.
(3.) The sum and substance of the FIR is that the accused committed rape with Km. Anjali on 22.12.2012. According to the informant, on 22.12.2012, when her daughter Anjali, aged eight years, went to pasture the goats in a nearby jungle, accused-revisionist sexually assaulted her. When she was returning to her home, she was unable to walk. Her private part was bleeding profusely. She was lifted on her way to home and was taken to the District Hospital for providing medical aid. Her private part was got stitched. The victim told that Anand Singh committed rape with her. An application for bail was moved before the Juvenile Justice Board, Champawat. The same was rejected on 30.01.2013. An appeal was preferred before the Sessions Judge, Champawat, who dismissed the appeal, vide order dated 15.02.2013. Aggrieved against the said order, present criminal revision was preferred. It is submitted by learned counsel for the State that charge sheet was submitted against the revisionist on 14.01.2013 and the trial (inquiry) is pending against the juvenile in conflict with law.;
