(1.) The applicants, by means of present petition under Section 482 Cr.P.C., seek to quash the summoning order dated 20.04.2009 as well as the entire proceedings of Complaint Case No. 53 of 2009, captioned as Shafakat Ali vs. Anjum Parvez, in relation to offences punishable under Sections 504 and 506 IPC, pending before learned Judicial Magistrate 1st Class, Pauri Garhwal.
(2.) Respondent filed a complaint case against the accused-applicants for the offences punishable under Sections 323, 504, 506 and 392 IPC in the Court of Judicial Magistrate, Pauri Garhwal. According to the complainant, the accused persons assaulted him, abused and threatened him with dire consequences on 05.04.2009, at 5:30 p.m. at bus stand at Pauri, when he was talking to his friend Pooran Lal.
It was alleged that applicant no. 1 assaulted him with kicks and fists, while applicant no. 2 caught hold of him. Applicant no. 1 also robbed the complainant of Rs. 900/-, which was kept in his pocket.
(3.) After the recording of statements under Sections 200 and 202 Cr.P.C., the accused-applicants were summoned to face the trial for the offences punishable under Sections 504 and 506 IPC by learned Judicial Magistrate, Pauri Garwal, vide order dated 20.04.2009. Aggrieved against the said order, present application under Section 482 Cr.P.C. was moved.;
