JUDGEMENT

- (1.) Pw1 Manika Devi lodged a first information report against the accused/revisionist Jagbeer Singh and Tara Chand for the offences punishable under Sections 409, 467, 471, 406 of I.P.C. read with Sections 109, 447, 448, 427 and 504 of I.P.C., which culminated into the chargesheet against them for the self same offences. The case was committed to the Court of Sessions.
(2.) When the trial began and prosecution opened it's case, charge for the self same offences were framed against them, in which they pleaded not guilty to the charge and claimed trial.
(3.) Pw1 Manika Devi, PW2 Ganga Prasad, PW3 Jai Prakash, PW4 Madia Singh, PW5 Bhagat Singh, PW6 Ram Singh, PW7 Srichand, PW8 Kirtidhar Chamoli, PW9 Prem Singh Rana, PW10 S.I. Shiv Singh Panwar and PW11 Shishpal Singh Aswal were examined on behalf of the prosecution. Incriminating evidence was put to the accused persons under Section 313 Cr.P.C., in reply to which they said that they were falsely implicated in the case. No evidence was given in defence.;
