JUDGEMENT

- (1.) The applicant, by means of present petition moved under Section 482 Cr. P.C., seeks to quash the summoning order dated 01.02.2010, entire proceedings of Criminal Complaint Case No. 660 of 2009, Sunil Kumar Arora vs. Swami Maheshwaranand, under Section 420 IPC, pending before the learned Judicial Magistrate, Haridwar.
(2.) The complainant (respondent no. 2 herein) filed a criminal complaint case against the accused (applicant herein) in the Court of Judicial Magistrate, Haridwar. After recording the statement of the complainant under Section 200 and statements of Naresh Kumar and Amar Nath under Section 202 Cr.P.C., accused was summoned to face the trial for the offence under Section 420 IPC, vide order dated 01.02.2010. Aggrieved against the same, present application under Section 482 Cr.P.C. was filed.
(3.) Respondent did not appear in this case despite service of notice upon him. No counter affidavit is filed on his behalf to rebut the contents of the affidavit filed by the applicant.;
