JUDGEMENT

- (1.) Present revision is directed against the judgment and order dated 04.07.2013 passed by Additional Sessions Judge, Tehri Garhwal, whereby appeal filed by the accused/revisionist was dismissed upholding the judgment and order 28.10.2010, passed by Judicial Magistrate, Narendra Nagar, District Tehri Garhwal, in Criminal Case No. 23 of 2008 convicting and sentencing the revisionist under section 451 and 332 of I.P.C.
(2.) Brief facts of the case are that revisionist on 05.05.2005, at about 3.45 pm, entered in police chowki Plasda, Police Station Narendra Nagar and assaulted constable CP-57 Raj Kishore Pandey and interrupted in his public duty as well as caused nuisance under influence of the liquor.
(3.) Both the courts below, having placed reliance on the statements of the witnesses have recorded concurrent finding of fact that accused/revisionist after entering into police chowki Plasda, assaulted constable CP-57 Raj Kishore Pandey under the influence of the liquor.;
