(1.) At the outset, it is pertinent to mention that none appeared on behalf of the complainant respondent despite personal service upon her. Hence, this Court rendered hearing to Mr. Parikshit Saini, learned Counsel for the applicant. Also perused the papers on record.
(2.) It transpires that the respondent Smt. Sangeeta Negi fled a Complaint Case No. 39/2008 in the Court of Judicial Magistrate, Laksar, District Haridwar with the averments that applicant Paramjeet cheated her on the pretext of getting her a job. On his promise to secure a job for her, she gave rupees two lakhs to the applicant, but neither he get her any job nor returned her money. When she demanded her money back, he threatened and intimidated her. Thereafter she lodged the complainant on 10.1.2008.
(3.) Complainant examined herself under Section 200 CrPC and her witnesses, namely, Sanjeev Negi (husband of the complainant) and Sukhbeer Singh were examined under Section 202 CrPC. Thereafter, learned Magistrate passed the impugned order of cognizance dated 15.2.2008 and summoned the accused applicant to stand trial for the offences under Section 420 and 506 IPC. Being aggrieved, this criminal miscellaneous application under Section 482 CrPC has been moved by the accused applicant.;
